Terms and Conditions of Sale

Article 1 – Purpose and Scope


These Terms and Conditions of Sale govern the contractual relationship between Sesame Nosy Be, operator of private catamaran cruises in Nosy Be (Madagascar), and any client making a booking.

Any booking confirmation implies full and unconditional acceptance of these Terms and Conditions, without exception.

 

Article 2 – Booking, Deposit and No Holding Option

 

No booking option can be held without payment. The booking is only confirmed upon receipt of a 30% deposit, payable immediately. Without this deposit, no date can be secured and the company remains free to accept other reservations.

The remaining balance must be paid no later than 30 days before departure. For any booking made less than 30 days before departure, full payment is required immediately.

Each day started is considered due.

 

Article 3 – Prices and Services


The communicated rates include the following services:

 

  • Private charter of the catamaran with a full crew: captain, deckhand, chef and hostess.

  • Accommodation on board with full board: breakfasts, lunches, snacks and dinners.

  • Non-alcoholic beverages and local alcoholic drinks.

  • Bed linen and towels.

  • Fuel.

  • Marine park fees.

  • Nautical equipment available on board: paddle boards and snorkeling equipment (fins, masks and snorkels).

 

The rates do not include:

 

  • Imported alcoholic beverages.

  • WiFi.

  • Air conditioning.

  • Fishing equipment.

  • Ground transfers.

  • Airport taxes.

  • Personal expenses or additional activities not explicitly mentioned in the initial quotation.

Article 4 – Cancellation by the Client

 

Any cancellation must be notified in writing to: contact@sesamenosybe.com 

 

  • The 30% deposit is refundable only within 7 days after confirmation. Beyond this period, it becomes strictly non-refundable, regardless of the reason.

  • Less than 30 days before departure: no refund of the remaining balance.

  • A credit valid for 12 months may be offered depending on availability.

  • Less than 7 days before departure: no refund and no credit will be possible.

 

No refund will be provided if the cancellation results from:

 

  • a personal, family or medical issue,

  • a delayed or cancelled flight,

  • a passport, visa or mandatory document issue,

  • illness, injury, pregnancy, hospitalisation,

  • temporary inability to navigate,

  • a change of itinerary decided by the captain.

 

Article 5 – Force Majeure and Exceptional Events


Under Malagasy law, force majeure includes in particular:

 

  • coup d’état, civil unrest, riots, blockades,

  • cyclones, tropical storms, dangerous swell, strong winds,

  • widespread outages (fuel, water, electricity, internet),

  • strikes, airport closure, flight cancellation or modification,

  • pandemics, health risks, government decisions,

  • circulation or navigation restrictions.

 

In case of force majeure: no refund may be claimed.

 

Sesame Nosy Be will offer, depending on possibilities:

 

  • a postponement of the cruise at no additional cost,

  • or a credit valid for 12 months.

 

No additional compensation may be claimed.

 

Article 6 – Mandatory Insurance (travel + international health + evacuation)


Given the limited medical facilities in Nosy Be, the client acknowledges:

 

  • that there is no high-level medical centre on the island,

  • that in case of a serious emergency, an air evacuation to Réunion, Mauritius or another country is mandatory,

  • that such evacuations are extremely costly and not covered by Sesame Nosy Be.

Therefore, each participant must subscribe to:

 

  • travel insurance including cancellation,

  • international health insurance,

  • emergency medical evacuation insurance,

  • insurance covering nautical activities.

 

Article 7 – Travel Recommendations (transport and schedules)

 

To limit risks linked to frequent cancellations of domestic Malagasy flights (Tana–Nosy Be), Sesame Nosy Be strongly recommends:

  • Choosing a direct international flight to Nosy Be rather than a route via Antananarivo, which is subject to cancellations, major delays and last-minute changes.

  • Planning a hotel night in Nosy Be the day before departure to avoid any stress or issues linked to delayed flights.

 

In case of delayed or cancelled flights or missed connections, no refund or compensation may be requested. The cruise will start or continue according to the initial schedule.

 

Article 8 – Captain’s Authority

 

The captain has absolute authority regarding:

 

  • passenger safety,

  • navigation,

  • itinerary modifications,

  • stops or delays,

  • cancellation of a stage or activity.

 

His decisions are final and do not entitle the client to any refund.

 

Article 9 – Safety, Conduct and Exclusions

 

Any behaviour that is:

 

  • disrespectful,

  • aggressive,

  • dangerous,

  • or compromising the safety of the vessel or order on board,

 

may result in immediate exclusion from the boat without refund, as well as invoicing for any damage caused.
 

Article 10 – Children and Minors

 

Children remain under the exclusive responsibility of their parents or guardians. The crew does not provide dedicated supervision.

 

Article 11 – Personal Belongings, Loss and Theft

 

Passengers’ personal belongings are not insured by Sesame Nosy Be. Clients must insure their valuables, personal equipment and luggage themselves.

 

Article 12 – Complaints

 

Any complaint must be sent in writing within a maximum of 15 days after the end of the cruise.

 

Article 13 – Applicable Law and Jurisdiction

 

These Terms and Conditions are governed by Malagasy law.

Only the courts of Madagascar have jurisdiction in case of a dispute.

 

Acceptance of the Terms and Conditions of Sale

 

By confirming the booking, the client acknowledges having read, understood and accepted these Terms and Conditions of Sale.
